Welcome to the Trash Bags website ("Site"). Please review the following basic terms that govern your use of and purchase of products from our Site. Please note that your use of our Site constitutes your agreement to follow and be bound by those terms (the "Agreement").

General

We may change the terms that govern your use of our Site. We may change, move or delete portions of or may add to our Site from time to time. Your use of our Site following any such change constitutes your agreement to follow and be bound by the terms as changed.

Product Information

All products are produced from recycled material and therefore colours vary for each item. Colours may appear slightly different via this web site due to computer picture resolution and individual monitor settings. Offers available until stocks sell out. When ordering by mail or email, if all items requested have sold out you will be notified by mail or email.

Delivery

Delivery within Australia will occur within 14 days of placing an order unless otherwise specified by Trash Bags at the time of order. We cannot accept responsibility for delays in delivery due to unforseen circumstances (political strife or natural disasters). Trash Bags uses Australia Post registered post for shipment of products. We aim to deliver products within 4-6 days to customers living in Adelaide, Melbourne, Canberra, Sydney and Brisbane. Customers living in regional areas or Tasmania and Western Australia should expect to receive products in 7-13 days. Should you require faster service please contact us and this can be arranged for you, please be aware that extra charges will apply.

Terms of Payment

Trash Bags accepts all major credit cards through the PayPal system. Credit cards will be billed at the time of purchase. Payment may also be accepted via direct debit. GST is included in the price of the product/s but will be shown as a separate entity on the proof of purchase. All orders will be completed when proof of payment has been recieved by Trash Bags.

Privacy

Trash Bags will not disclose, sell, rent or exchange your personal information to any third party for any reason other than to ensure that we can effectively complete the transaction of the purchasing of your products. Neither will we send you any unsolicited mail or email.

Returns

If you are not satisfied with your Trash Bags product when you receive delivery please return it to us within 14 days, unused and in a saleable condition in the original packaging and we will refund your money (exempting shipping costs). Please enclose a copy of proof of purchase.

If there is any fault with the product, return it to us, with a copy of the proof of purchase and we will send you a replacement. Please note, however, that Trash Bags products are made from recycled material, each item is individual and unique, colours will vary for each item. Colours may also appear slightly differently via the website due to computer picture resolution and individual monitor settings. Trash Bags, therefore accept no responsibility in regards to colour accuracy of items sold.

Stockists

Most Trash Bags products displayed at the Site are available in select stockist stores in Australia. In some cases, merchandise displayed for sale at the Site may not be available at Trash Bags stockists. The prices displayed at the Site are quoted in Australian Dollars (AUD).

Site Content

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials that appear as part of this Site (collectively, the "Contents") are copyrights, trademarks and/or other intellectual properties owned, controlled or licensed by Trash Bags collectively, and its subsidiaries and/or affiliates. The Site as a whole is protected by copyright. The Contents of our Site, and the Site as a whole, are intended solely for personal, noncommercial (other than for the purchase of merchandise from our site) use by the users of our Site. You may not download or copy the Contents and other downloadable materials displayed on the Site for your personal or commercial use. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading or copying. Trash Bags Communications to You

You agree that Trash Bags may send electronic mail to you for the purpose of advising you of your transaction with Trash Baggs and product details required by that transaction. Trash Bags will not send/ email or other wise communicate advertising material to you unless expressly agreed to you by the terms and conditions of the membership program. Trash Bags reserves the right to communicate changes and additions to the site in regards to terms and conditions of use as Trash Bags deems appropriate.

To the extent that this Site contains links to outside services and resources, the availability and content of which Trash Bags does not control, any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource.

Inaccuracy Disclaimer

From time to time there may be information on the Trash Bags site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice (including after you have submitted your order). We apologise for any inconvenience this may cause you. If you are not completely satisfied with your Trash Bags purchase you may exchange it with your invoice by mail.

Indemnification

You agree to defend, indemnify and hold Trash Bags harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site.

Unless otherwise specified and except to the extent Trash Bags products are offered for sale through this Site, this Site and the Contents thereof are displayed solely for the purpose of promoting Trash Bags products and services available in the Australia and select foreign markets. This Site is controlled and operated by Trash Bags from its offices in Sydney and Lismore, Australia. This Agreement shall be construed in accordance with the laws of the State of New South Wales, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of New South Wales and Australia.

Termination

This Agreement is effective unless and until terminated by either you or Trash Bags. You may terminate this Agreement at any time. Trash Bags also may terminate this Agreement at any time and may do so immediately without notice, and accordingly deny you access to the Site, if in Trash Bags sole discretion you fail to comply with any term or provision of this Agreement. Upon any termination of this Agreement by either you or Trash Bags, you must promptly destroy all materials downloaded or otherwise obtained from this Site, as well as all copies of such materials, whether made under the terms of this Agreement or otherwise.
